Terms and Conditions of Use – AutoPijaca

You acknowledge that these terms and conditions represent the entire agreement between you and AutoPijaca concerning your use of the platform and supersede all prior agreements. AutoPijaca reserves the absolute and unrestricted right to modify, amend, update, revise, or replace these terms and conditions at any time, for any reason, and without prior notice. It is your sole responsibility to review these terms periodically. Your continued access to or use of the platform after any changes constitutes your binding acceptance of those changes. AutoPijaca shall not be liable for any loss or damage you may suffer as a result of such modifications.

AutoPijaca is solely an online technology platform that acts as an intermediary connecting sellers and buyers of vehicles, spare parts, accessories, and related services. AutoPijaca does not own, sell, purchase, import, service, or act as a dealer for any vehicle or item listed on the platform.

AutoPijaca does not verify the accuracy of advertisements, does not perform technical inspections of vehicles, does not check the legal status of vehicles, and does not guarantee the condition, mileage, origin, or any other details of any listing. All transactions, negotiations, price agreements, payments, and transfer of vehicles occur exclusively and directly between the seller and the buyer. AutoPijaca is not a party to any contract concluded between users.

AutoPijaca expressly disclaims any and all liability for:

• inaccurate, incomplete, or false information in any advertisement
• mechanical condition, defects, or roadworthiness of any vehicle or part
• fraud, misrepresentation, or scam by any seller or buyer
• any damage occurring during inspection, test drive, transportation, or delivery
• any financial loss, failed transaction, or dispute between users
• any consequences arising from the use of the platform

As a buyer, you are solely and fully responsible for verifying all aspects of the vehicle before purchase. You must:

• personally inspect the vehicle
• arrange and perform a professional technical inspection by a qualified mechanic
• verify all documentation (registration, ownership, service history, etc.)
• negotiate all terms and conditions directly with the seller

You accept that you bear all risks associated with purchasing any vehicle or item through the AutoPijaca platform, including the risk of hidden defects, incorrect mileage, legal issues, or any other undesirable outcomes.

As a seller, you bear full and exclusive responsibility for the accuracy and truthfulness of all information in your advertisement. You must provide correct details regarding year of manufacture, mileage, damages, repairs, accidents, and the actual condition of the vehicle. You are prohibited from advertising stolen, written-off, legally disputed, or technically unsafe vehicles without clearly stating such facts.

You guarantee that you have the legal right to sell the vehicle and that the advertisement complies with all applicable laws. In case of false or misleading information, you will bear full legal and financial liability toward the buyer and any third parties.

AutoPijaca reserves the following rights:

• to modify these terms and conditions at any time without prior notice
• to remove any advertisement from the platform at any time, without explanation and without any liability
• to suspend or permanently ban any user at any time, without explanation and without any liability
• to restrict or terminate access to the platform for any user at its sole discretion

The following activities are strictly prohibited on the platform:

• posting stolen, written-off, or illegally obtained vehicles or parts
• posting false, misleading, or deceptive advertisements
• misrepresenting your identity or providing false user information
• harassing, threatening, or abusing other users
• posting duplicate or spam advertisements
• engaging in any activity that violates the laws of the Federation of Bosnia and Herzegovina

AutoPijaca collects and processes your personal data (name, email, phone number, etc.) solely for the purpose of operating the platform and in accordance with the applicable data protection laws in Bosnia and Herzegovina. We do not sell, rent, or share your personal data with third parties except as required by law.

To the maximum extent permitted by law, AutoPijaca shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. AutoPijaca's total liability shall not exceed the amount you paid to AutoPijaca (if any) in the twelve months prior to the claim.

You agree to indemnify, defend, and hold harmless AutoPijaca, its owners, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, and expenses arising out of your use of the platform, your violation of these terms, or your interactions with other users.

These terms shall be governed exclusively by the laws of the Federation of Bosnia and Herzegovina. Any dispute arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the competent courts in Sarajevo, Federation of Bosnia and Herzegovina.

These terms constitute the entire agreement. If any provision is held invalid, the remaining provisions shall remain in full force. Headings are for convenience only.
